Failing to Register a Vehicle Ticket
To start with, after buying a motor vehicle, the prerequisite to driving it is registering it. When Does a Florida Vehicle Registration Expire?
For a vehicle owned by a natural person, Florida law generally provides that the registration expires at midnight on the owner’s birthday. Florida also allows annual or biennial registration periods in qualifying cases, so the applicable renewal period depends on the registration.
Penalties for an Expired Vehicle Registration in Florida
Florida Statute §320.07 sets different consequences depending on how long the registration has been expired and whether the person has a prior qualifying offense.
Expired Six Months or Less
A registration expired for six months or less generally results in a noncriminal traffic infraction treated as a nonmoving violation. For this category, an officer may not issue a citation until midnight on the last day of the owner’s birth month in the year the registration expires.
Expired More Than Six Months — First Offense
A first offense involving a registration expired for more than six months is subject to the noncriminal traffic-penalty procedure provided by Florida law.
Expired More Than Six Months — Second or Subsequent Offense
A second or subsequent offense involving a registration expired for more than six months is a second-degree misdemeanor. A second-degree misdemeanor is generally punishable by up to 60 days in jail and a fine of up to $500.
A criminal misdemeanor therefore does not arise merely because a registration has expired for more than six months. The prior-offense requirement matters.
