Do I Have A Case?
Not every auto accident leads to a valid injury claim, but if someone else’s negligence caused your injuries, you may have the right to seek compensation. Factors such as fault, the severity of your injuries, available insurance coverage, and the impact the accident has had on your life all play a role in determining whether you have a case. Our experienced auto accident attorneys can evaluate your situation, answer your questions, and explain your legal options. Explore the information below to learn more about when you may have a valid injury claim.
You Have 14 Days
The 14 Days After Your Accident Can Be Critical for PIP Medical Benefits.
After an auto accident, you may not immediately feel the full extent of your injuries. Pain, stiffness, headaches, and other symptoms can sometimes become more noticeable hours or days later. That is one reason it is important to take your health seriously and seek appropriate medical care promptly.
Florida law also has an important 14-day rule for Personal Injury Protection, commonly called PIP. To qualify for PIP medical benefits, initial medical services and care generally must be received within 14 days after the motor-vehicle accident.
Waiting longer than 14 days does not automatically eliminate every possible injury or liability claim. The 14-day rule specifically affects qualifying PIP medical benefits. Other insurance claims and claims against an at-fault party are governed by separate rules.
PIP generally provides up to $10,000 in combined medical and disability benefits. Covered medical expenses are generally reimbursed at 80%, and qualifying lost-income benefits are generally paid at 60%, subject to Florida law and the applicable policy.
The amount available for medical reimbursement also depends on the medical determination. If an authorized provider determines that you had an emergency medical condition, qualifying medical reimbursement may be available up to the applicable $10,000 PIP limit. If you are determined not to have an emergency medical condition, qualifying medical reimbursement is generally limited to $2,500.
Receiving a traffic citation after an accident also does not, by itself, decide who is responsible for your injuries or determine whether you qualify for PIP benefits. Fault, insurance coverage, available damages, and other legal issues depend on the facts of the crash and the applicable law.
Depending on the circumstances, an injured person may be able to pursue compensation for medical expenses, lost income, property damage, and other losses. Pain-and-suffering and other noneconomic damages in Florida motor-vehicle cases are subject to additional legal requirements.
At RHINO Lawyers, our car accident lawyers can review what happened, explain which benefits and claims may be available, communicate with the insurance companies, and help you understand the next steps. We can also address vehicle damage and transportation issues when those services are available in your case.
The sooner we understand what happened, the sooner we can help identify the deadlines, insurance benefits, and legal options that may apply to you.
Crash Investigation
Every Day, Our Team Handles & Wins Similar Cases.
If you received a traffic ticket after your accident, the officer who cited you could have made an error in judgment because he/she likely did not witness your crash.
The RHINO Lawyers team completes its own crash investigation and takes every crash case seriously because we know harsh consequences can result if “fault” is not contested. We’ll support your explanation of how your accident occurred with strong evidence. And guide you through what happens inside and outside of the courtroom.
